DISCLAIMER

Please read these Terms and Conditions carefully before using this website. By accessing, using and/or purchasing products, subscribing to newsletters or posting reviews on this web site, you signify your consent to these Terms and Conditions. The website is owned and operated by JÓIA SA (VAT number 500909300), a company incorporated under the laws of Portugal. You may not copy, reproduce, republish, upload, post, transmit or distribute in any way the contents of this website including but not limited to the text, images, audio and video for public or commercial purposes, without written permission from JÓIA SA. The acceptance of the terms and conditions of sale there implies the enforcement of these conditions. They apply to all orders placed by the customer on the site www.cloud-footwear.com. These general conditions of sale may be subject to amendment.

PRODUCTS

The products we sell online are displayed on this Website and include but are not limited to footwear and shoe care products. We reserve the right to modify at any time the information, the range of products, prices and promotions.

VALIDITY OF OUR OFFERS

The items displayed on the site are available while stocks last. CLOUD-FOOTWEAR.COM will notify the customer by email should an unavailable item be ordered. In the case of a debit or payment of an item that is not available, CLOUD-FOOTWEAR.COM commits to propose a credit note or refund to customers within 15 days. The order will be cancelled automatically.

PLACING AN ORDER

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement that we have received your offering to purchase a product and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your order is ready to be shipped at which time we send you an order confirmation as well as the invoice and shipment information. Hence, the contract is concluded at the moment when we send you an order confirmation. We will not charge your card with any amount before shipping your products, however an amount may be reserved on your card in order to ensure sufficient funds to cover the payment. You accept that all communication regarding the order including order confirmation, invoice, shipping information, confirmation of the contract conclusion etc. is done via e-mail.

PAYMENT METHODS

You can purchase products using Credit Card and Paypal. Users from Portugal, may also choose the payment method Referência Multibanco. For security reasons, we do not store any payment information in our database.

DELIVERY

For shipping in Portugal, we work with CTT. When you placed the order, you can check the rate associated. For orders placed and confirmed before 14:00 GMT, the delivery time is 1-2 working days. For international shipping, we use two services from UPS to ship your orders: UPS Standard and UPS Express Saver. You can check the rates and select which service would like to use when placing the order. For orders placed and confirmed before 14:00 GMT, the delivery time is by the end of the next working day for Europe and 3-5 days for the rest of the World. You will be sent a dispatch confirmation email as soon as your order has been processed. This email will also contain your tracking number, you can confirm the status of your delivery. Customs and import duties are charged once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel. Unfortunately, we have no control over these charges, and cannot tell you what the cost might be, as customs policies and import duties vary widely from country to country. It might be a good idea to contact your local customs office for current charges before you order, so you are not surprised by charges you were not expecting. The customer must take full liability for any parcels returned to us due to unpaid customs charges. Postal charges, return shipment costs, customs charges and handling fees will all be deductible from any refund due.

RETURN AND EXCHANGE POLICIES

The items available are described and presented with as much precision as possible. You must read the description of each product in order to know the specific details and properties, the choice and purchase of a product is entirely your responsibility. However, if you are not fully happy with the goods you have received, you can return them to us within 14 days of receipt, providing they are in original resalable condition. Once returned you will be entitled to receive an exchange or a refund. Unfortunately, we cannot offer our customers a refund for the original postage. We are not able to refund or exchange items that appear to have been worn, washed, or are not in original condition. So please make sure you try the goods received in a well-conditioned environment, in order to preserve the goods in perfect selling order if returning. This does not affect and is in addition to your statutory rights as a consumer. Please enclose the completed Returns Form we have sent to you with the original package with your return, and make sure all returned items are well packaged, so as not to be damaged in the post. Please ensure all return packages are sent with a traceable, insured service, as we cannot take responsibility for items damaged or lost in the return transit. As long as the returned items meet our refund criteria, your refund will be with you 24-48 hours after your return is processed. The refund will be done through the same payment method you selected when placing the order. As we said before, we cannot pay for the return postage on items that are unsuitable, for which our customers just changed their mind... however we will send any replacement items to you free of charge within Europe. If you are returning a defective or faulty item for a refund, we will refund both the original shipping costs and the return delivery costs. Please make sure you understand we will not be refunding the original postage charge so your Credit Memo will not show the original delivery charge refunded, but only the cost of the item(s) bought. If you live outside the European Union please understand we will not be refunding any Custom or Tax charges that were eventually paid when the package entered your country. Your local custom authority may charge you for tax and customs but these are charges that are outside our control.

WARRANTY

Our products benefit from the warranty in accordance with the legislation applicable to the sale of consumer goods. The guarantee of conformity does not apply in case of modification on the product, in case of normal wear and tear of the product, in case of improper use of the product, in case of non-respect of the rules of maintenance of the product and for damage caused by transportation or storage of the product. The replacement or repair of the product will be free of charge within a reasonable time unless it is disproportionate to the damage or if this is impossible. The product in question must have been ordered from the CLOUD-FOOTWEAR.COM site and returned in the original packaging.
